Terms of use
These Terms of Use govern your use of Balm and describe the rights and obligations associated with it.
Balm
Balm is a digital service provided by Significo GmbH (“Significo” or “we”). Further information about Significo can be found in our imprint.
Conditions for using Balm
You must be of legal age to use Balm.
You must consent that we may process the data you provide during registration and your answers to questions in Balm to fulfill the user agreement with you. Optionally, you can also consent that we may use these data for the following additional purposes: improvement and further development of the product; and pseudonymization of your data and use of the pseudonymous data for research purposes.
Content and information provided in Balm
With Balm, we want to provide you with information on health topics related to lifestyle and behavior changes. For this purpose, we particularly use various questionnaires in Balm. We may notify you by email about content in Balm that is relevant to you.
You may also use Balm to access third-party content made available via Balm. If you decide to access such third-party content, the quality of that content is governed by your agreement with the third-party provider, and Significo is not responsible in this regard (Significo’s mandatory legal obligations as a provider of hosting services remain unaffected).
All contents and information in Balm are not medical services and cannot replace a doctor’s visit or other medical services.
Conclusion of the contract
The contract for the use of Balm is concluded when we confirm your registration. Use of Balm is then immediately possible.
Termination of the contract
The contract for your use of Balm is concluded for an indefinite period. Both you and we can terminate the contract for convenience at any time without notice.
Your rights in the event of defects
In the event of a defect, the statutory warranty rights apply.
Personal and private use
Your Balm user account is non-transferable and may only be used by you for your own personal and private purposes.
Changes to Balm and/or to these terms
We reserve the right to amend or change the functionalities of Balm at any time, provided that this is necessary to adapt to market conditions, to adapt to current technical conditions, to prevent misuse or damage, or to comply with legal obligations, and users are not unreasonably disadvantaged contrary to the requirements of good faith. This presupposes that no additional costs arise for you and that you are clearly and comprehensibly informed.
We also reserve the right to change or amend these Terms of Use with your consent—particularly when necessary for the smooth and safe operation of Balm. You will be notified in advance in writing or electronically. If you do not object within one month after receipt of the notification, the change shall be deemed accepted. We will expressly draw your attention to this in the notification. Substantial changes comparable to the conclusion of a new contract are only possible with your express consent.
Languages
Balm is currently only available in English and German.
Online dispute resolution
We are neither obliged nor willing to participate in a dispute resolution procedure before a consumer dispute resolution board.
Information on the right of withdrawal
Right of withdrawal: You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract.
To exercise your right of withdrawal, you must inform us (Significo GmbH, Cuvrystraße 1, 10997 Berlin, Germany, E-Mail: balmsupport@significo.com, telephone: +49 30 3434919-0) of your decision to withdraw by an unequivocal statement (e.g., letter, fax, or email). You can use the attached template withdrawal form, but this is not mandatory. To comply with the deadline, it is sufficient to send the notification before the period expires.
Consequences of withdrawal
If you withdraw, we will reimburse all payments received from you, including delivery costs (except additional costs resulting from a different type of delivery than the least expensive standard delivery offered by us), without undue delay and at the latest within 14 days from the day we are informed of your decision. We will use the same means of payment you used unless otherwise expressly agreed, and you will not incur any fees for this repayment.
If you requested that services commence during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of services already provided up to the time at which you informed us of your decision, compared to the total scope of the services provided for in the contract.
